Terms of Service

1. Introduction
These Terms govern the use of EMDR Online (the “Service"), an online tool that supports therapists' work. The Service is operated by , Politechniczna 9/5, 80-180 Gdańsk, 5833100159 (the “Operator").

2. Definitions
- Service — an online tool for running bilateral stimulation (a moving ball, optional bilateral audio) controlled in real time.
- Therapist — an adult user who creates an account and uses the Service in their practice.
- Client — a person to whom the Therapist shares a session link. The Client does not create an account.
- Session — a single motion configuration shared via a unique link.
- Directory — the public list of EMDR practitioners made available in the Service.
- Listing — a Therapist's profile in the Directory, created voluntarily and published after verification.
3. Nature of the Service — important notice
The Service is a technical tool that supports qualified therapists. It is not a medical device, does not diagnose, does not provide therapy, and does not replace consultation, diagnosis or treatment by a qualified professional.
The Operator does not provide medical or psychotherapeutic services. The Therapist is solely responsible for the appropriateness and manner of using the tool with a Client, including their qualifications, obtaining the Client's informed consent, and safety.
4. Accounts
- Only Therapists may hold accounts; the Client never logs in.
- The Therapist provides accurate information and is responsible for password confidentiality and activity on their account.
- The Operator may refuse registration or suspend an account for breach of these Terms or the law.
5. Plans, free trial and payments
- The Service includes a free trial covering up to 3 sessions. After that, creating further sessions requires an active subscription.
- Monthly and yearly plans are available. Current prices are shown on the Pricing page.
- Payments are processed by Stripe. The Operator does not store full card details.
- Subscriptions renew automatically each billing period until cancelled. You can cancel anytime via the customer portal; access remains until the end of the paid period.
- Consumers retain their statutory rights. Starting a digital service with your express consent before the withdrawal period ends may limit the right of withdrawal for the part already performed.
6. Practitioner directory
- Joining the Directory is voluntary. The Therapist decides whether to create a Listing and whether it is visible; they can hide or delete it at any time.
- A Listing is public — once approved it is visible to all visitors and may be indexed by search engines. The Therapist is responsible for the accuracy and currency of its content.
- Before a Listing is published, the Operator verifies the uploaded EMDR credential document. The Therapist represents that they hold the stated qualifications and are entitled to use them.
- Verification is a basic document check and does not constitute a recommendation, warranty or endorsement of the Therapist by the Operator. Choosing and contacting a Therapist is at the sole responsibility of the interested person.
- The Operator may refuse to publish, suspend or remove a Listing — in particular where documents are doubtful or the content is untrue, inappropriate, or breaches these Terms or the law.
- The contact form on a Listing is for making contact on therapeutic matters. Using it for spam, marketing or other abuse is prohibited.
7. Acceptable use
You may not use the Service unlawfully or in a way that infringes others' rights, including: sharing your account with unauthorised persons, attempting to breach Service security, automated scraping, or using the Service for purposes other than supporting therapeutic work.
8. Intellectual property
The Service, its software, marks and content are protected by law. The Therapist receives a non-exclusive, non-transferable licence to use the Service for the term of the agreement.
9. Limitation of liability
The Service is provided “as is". To the extent permitted by law, the Operator is not liable for damages arising from the Therapist's clinical decisions, technical interruptions, the Client's network, or health outcomes of using the tool. Nothing herein excludes liability that cannot be excluded under mandatory law (including towards consumers).
10. Availability and changes
The Operator strives to keep the Service running but does not guarantee uninterrupted availability and may perform maintenance and evolve features.
11. Termination
The Therapist may stop using the Service and delete their account at any time. The Operator may suspend or close an account for a material breach of these Terms, respecting consumer rights.
12. Complaints
Complaints can be sent to kontakt@emdronline.pl and are handled within the statutory timeframe (no longer than 14 days for consumers).
13. Changes to these Terms
The Operator may amend these Terms for valid reasons (e.g. legal, technological or scope changes) with reasonable prior notice. Continued use after changes take effect constitutes acceptance.
14. Governing law and disputes
Matters not covered here are governed by the law of Polska. Consumer disputes are resolved under applicable rules; consumers may use out-of-court dispute resolution.
